I have seen it many times, parties coming into a mediation session unprepared or not knowing how to negotiate.
Scenarios like this put the Mediator in a predicament as he would be unable to move the session as the conversation will be stagnant, or the proposals put forward may not make sense to the other litigant. It can agitate the other disputant, and the entire Mediation would fail.
