I had a case that appeared before me that involved in varying a court order.
The case is about this elderly couple who at the time point of divorce agreed on monies to be transferred from two different accounts of the husband's CPF. It now seems that there is a shortage in that account. Now the wife wants to move from ex-husband’s OA account entirely. The ex-husband is agreeable to this arrangement.
I discovered that there will be a shortage still and shared that with the parties. The wife responded that it is OK as ex-husband is working and should be fine by the time they effect the order. I shared with the parties that it is impossible as the Court would only agree to a Consent if it satisfies the President. Her request today is premature. I shared they had two options, post-pone the case to a later date till it satisfies the request or readjusts the order with a larger some from the OA and balance to come either from the other accounts.
