Collaborative Mediation - Divorce


I came across a rather complicated situation in a Divorce Mediation this week. It was the 2nd round of Mediation, both parties were represented.


The couple was married for about 30+ years. The husband has been the primary breadwinner of the house. The wife has been a homemaker most of her life who does some odd jobs here and there. The financial contribution to the marital home is nominal.


Both parties are above 55, whilst the husband is still working but has a relatively low income. Hence, the majority of the parties money is locked in with their asset. To make matters worst their help is within MOP.


I indicated to the parties that this is a crunch of the case and we will have to work out a solution to ensure that both parties can continue to live after separation. We discussed what were the pitfalls and options then we broke up where parties, discuss with their counsels work out a reasonable solution.


After some time they came with a solution that they will dispose the marital flat and worked out a sharing proportion that parties are agreeable to.
